SMS Terms and Conditions

These SMS Terms and Conditions govern participation in the Arkscan, LLC customer support SMS messaging program ("SMS Program"). By providing your phone number in connection with a customer support request and engaging in SMS communications with Arkscan, LLC ("Arkscan," "we," "us," or "our"), you agree to these SMS Terms and Conditions.

1. Purpose of SMS Program

The SMS Program is used solely for customer care and technical support communications related to Arkscan products and services.

SMS messages may include:

  • Responses to customer initiated support requests
  • Troubleshooting communications
  • Support session coordination
  • Case updates and follow ups
  • Service related communications directly connected to an active support interaction

The SMS Program is not used for advertising, marketing, promotional campaigns, or unsolicited outreach unless separate explicit consent is obtained.

2. Consent to Receive SMS Messages

You consent to receive SMS messages from Arkscan when you:

  • Submit a customer support request
  • Provide your phone number during a support interaction
  • Request follow up communication related to a support case

Consent applies only to communications related to your support request or service interaction.

3. Message Frequency

Message frequency varies depending on the nature of your support request and ongoing technical assistance needs.

Arkscan does not send recurring automated marketing campaigns through this SMS Program.

4. Message and Data Rates

Message and data rates may apply depending on your wireless carrier and mobile plan. Arkscan is not responsible for carrier charges or fees associated with SMS messages.

5. Opt Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any SMS message.

After you send STOP:

  • You will receive a confirmation message
  • You will no longer receive SMS messages from Arkscan under the current support case
  • Further SMS communication will occur only if you initiate a new support request and provide consent

7. Privacy and Data Use

Information collected in connection with the SMS Program is processed in accordance with Arkscan’s Privacy Policy, available at https://www.arkscan.com/privacy-policy.

Your phone number and related support communications are used solely for customer support, operational, legal, and security purposes unless separate consent is provided for additional uses.
Arkscan does not sell or share SMS opt-in data or mobile phone numbers with third parties for marketing or promotional purposes.
Nothing in these SMS Terms modifies the data collection, processing, advertising, analytics, or profiling practices described in the Privacy Policy or Software License Agreement.

8. Disclaimer of Warranties

The SMS Program is provided on an "as is" and "as available" basis. Arkscan does not guarantee uninterrupted delivery, message receipt, compatibility with all mobile devices, or error free operation.

Wireless carriers are not liable for delayed or undelivered messages.

9. Limitation of Liability

To the maximum extent permitted by law, Arkscan shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the SMS Program.

Arkscan’s total aggregate liability arising out of or relating to the SMS Program shall not exceed one hundred U.S. dollars (USD $100).

Nothing in these SMS Terms expands liability beyond the limitations contained in the Arkscan Software License Agreement.

10. Governing Law and Dispute Resolution

These SMS Terms are governed by the laws of the State of New York.

Any dispute arising out of or relating to the SMS Program shall be resolved in accordance with the arbitration and class action waiver provisions contained in the Arkscan Software License Agreement.

11. Modifications

Arkscan may modify these SMS Terms from time to time. Updated versions will be posted publicly and will become effective upon posting.

Continued participation in the SMS Program after updates constitutes acceptance of the revised terms.
