SECTION 5 - SMS COMMUNICATIONS
If you provide a phone number for customer support purposes, you consent to receive service-related SMS communications. Message frequency varies. Message and data rates may apply. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKSCAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS.
IN NO EVENT SHALL ARKSCAN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

You agree to indemnify and hold harmless Arkscan and its affiliates, officers, directors, employees, contractors, and licensors from any claims, damages, liabilities, and expenses arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate access to the Services at any time for violation of these Terms or for any lawful reason. Obligations that by nature should survive termination shall survive.

These Terms, together with the Privacy Policy, SMS Terms, and applicable Software License Agreement, constitute the entire agreement between you and Arkscan regarding the Services.
